Job Description:

POSITION PURPOSE. This position provides professional legal support by: (i) managing pre-litigation claims, including preparation of settlement and release agreements, customer response/denial letters and settlement negotiations; (ii) drafting and negotiation of simple contracts, SOWs, amendments; (iii) updating of customer-facing and service provider-facing documents; and (iv) project managing key client relationships. The Legal Specialist will serve as the liaison between Home Depot Services, HD Rental, Legal and other departments specifically including Customer Care, General Liability, and Customer Litigation. Duties may include drafting legal and business communications and correspondence, participating in the administration and negotiation of pre-litigation claims, general filing and database management, gathering facts and documentation, responding to litigation requests, and responding to customer legal inquiries. As needed, the Legal Specialist will provide support in connection with the management of special projects and other department or company initiatives. MAJOR TASKS, RESPONSIBILITES AND KEY ACCOUNTABILITIES. Manage incoming pre-litigation customer escalations. Candidate should have the ability: (i) gather and review relevant documents (e.g., contracts, demands, customer correspondence) and case notes to identify key issues; (ii) liase with General Liability and Customer Care departments to resolve customer issues; (iii) coordinate with service providers, merchants and field associates to understand relevant facts for claim resolution and pre-litigation responses; and (iv) assist with the case management of customer claims. Under supervision, conduct legal research and respond to legal inquiries requested by field and store associates (e.g., contracts, liens, HOA documents, POAs, NDAs, subpoenas, and traffic violations) and provide recommendations as to course of action. Under supervision, draft business/legal communications typically using template forms (e.g., contracts, cease/desist letters, settlement and release agreements). General file/database management - maintain complete and accurate electronic and paper files for all assigned matters. Negotiate settlement of smaller matters (e.g., small-claims litigation, low regulatory fines) or negotiate smaller contracts/ amendments/statements of work. Other tasks as assigned by supervisor. NATURE AND SCOPE. Position reports to Senior Corporate Counsel or Assistant General Counsel . No direct reports. Environment: Located in a comfortable indoor area. Any unpleasant conditions would be infrequent and not objectionable. Travel: Typically requires overnight travel less than 10% of the time. MINIMUM QUALIFICATIONS. Must be eighteen years of age or older. Must be legally permitted to work in the United States. Education Required: The knowledge, skills and abilities typically acquired through the completion of a bachelor's degree program or equivalent degree in a field of study related to the job. Years of Relevant Work Experience: 5 years. Occasions there may be a need to move or lift light articles. Legally eligible to work in the United States. Preferred Qualifications: Paralegal certificate . 3-5 years' experience as a claims paralegal in a law firm or corporate legal department. Familiarity with legal concepts relevant to the construction industry. Knowledge, Skills, Abilities and Competencies: Excellent organizational skills, with the ability to prioritize the completion of multiple responsibilities. Excellent writing skills .
